Belmont Beverages Headquarters: When its downtown store and headquarters were threatened with condemnation to make way for the Harrison Square development, Belmont Beverage Stores of Indiana enlisted us to assist with the legal work of relocating. We negotiated the buy-out of an existing lease that allowed Belmont to acquire an adjacent property. Then we negotiated access easements with abutting landowners and obtained the land use approvals and permits necessary to combine two buildings and lots into one property. We also helped with the renovation of the storefront and parking lot.

Cedar Springs Subdivision: We routinely work with developers of residential subdivisions, including Cedar Springs Subdivision, which is developed by Max Shambaugh’s company M-B-C Corp. Our attorneys worked closely with the project engineer to obtain the governmental approvals necessary to plat the subdivision, including negotiating various utility easements and development and maintenance agreements. We also drafted covenants governing the use and development of the subdivision and created the subdivision’s owners association.

Hanson Ardmore Quarry: Our attorneys assisted Hanson Aggregates Midwest, Inc. in expanding its limestone quarries in northern Indiana. Our involvement included negotiating the assemblage of the real estate needed for the expansion, coordinating the vacation and closing of a public road, rezoning the additional property and obtaining the necessary land use approvals and permits.

Illinois Professional Park: Steven J. Hoagburg, DDS, and James P. Klinger, DDS, enlisted our services to locate and develop a professional office park for their practices. The firm assisted in locating and acquiring the parcel, rezoning the property, obtaining all necessary land use approvals and permits, negotiating with the Indiana Department of Transportation, negotiating cross-access agreements with adjoining properties and creating the office park owners association.

Maysville Pointe Shopping Center: The firm assisted in all facets of developing this shopping center in northeast Fort Wayne. We negotiated the purchase agreements and land acquisition, rezoned the real estate, obtained other land use approvals and created the commercial owners association.

The Shoppes and Offices at Scott Road: This development for The Rogers Company was particularly important to the firm, as we were the first purchaser of a unit in the office condominium section of this project. We drafted the retail commercial and office condominium declarations as well as the condominium association documents for the offices. Then, in January 2004, we proudly took ownership of the first condominium unit in this project.

Republic Services Landfill Expansion: We have been called on to assist in zoning proceedings for creating and expanding landfills in the northeast Indiana. We worked closely with environmental engineers, hydrogeologists and other scientific consultants to complete the land use approval and permitting process.

Keller Development, Inc. Tax Credit Projects: We work regularly with this local, third-generation company developing low-income housing tax credit, multi-family projects throughout Indiana. We assist in site selection and acquisition, obtaining rezoning and other necessary land use approvals and tax abatement proceedings.

STAR Financial Bank Branch: When STAR Financial Bank encountered problems attempting to construct a bank branch that included a Starbucks, bank officials called our lawyers to get the necessary approvals to complete the project. We successfully rezoned the site to a higher commercial classification to accommodate the new commercial use and obtain the necessary land use approvals to allow this unique concept to move forward.

Vreba-Hoff Dairy CAFOs: We have represented this multi-national agribusiness in land use and zoning proceedings, as well as related litigation, for large dairy-confined feeding operations in Indiana. Although this land use—like mining operations, landfills and similar businesses—generates substantial opposition from nearby property owners, the experience and reputation of our lawyers resulted in a number of successful administrative and court decisions for our client.
